Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) sets out the categories of content, conduct, and use that are prohibited on the Better Listing Media platform (the “Platform”). It is incorporated into our Terms of Service and applies to every user, account, and integration. Violations may result in immediate suspension or termination of the offending account, forfeiture of remaining credits, indemnity obligations to Better Listing Media, and referral to law enforcement.
1. Prohibited content categories
You may not upload to the Platform, transmit through the Platform, or use the Platform to process or distribute, any of the following:
- Content sexually exploiting or endangering minors (CSAM), or any content that sexualizes anyone reasonably appearing to be under 18. We report all such content to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
- Non-consensual intimate imagery of any individual.
- Sexually explicit content generally.
- Content depicting or facilitating violence, terrorism, mass-casualty events, or weapons of mass destruction.
- Content infringing intellectual-property rights of any third party (copyright, trademark, trade secret, right of publicity, right of privacy, contractual right). See our DMCA Policy.
- Content depicting identifiable people without their consent where consent or a model release is required by law.
- Content that depicts, sexualizes, or threatens any specific real person in a manner that constitutes harassment, defamation, or impersonation.
- Doxxing or personally identifying information intended to enable harassment, stalking, or harm.
- Synthetic or deepfake imagery of identifiable persons, public officials, candidates, or commercial entities created or modified to deceive.
- Content unlawful in the jurisdiction of upload, processing, or delivery.
- Content used to discriminate in housing, lending, employment, or any other context against a protected class.
- Content used to conceal material property defects required to be disclosed under your jurisdiction's real-estate or consumer-protection rules (see our Real-Estate Use Policy).
2. Prohibited conduct
You may not, and may not permit any third party to:
- circumvent, disable, or interfere with rate limits, quotas, billing, security, or other access controls;
- scrape, crawl, or systematically extract data from the Platform;
- reverse-engineer, decompile, disassemble, probe, or otherwise attempt to derive the source code, model weights, system prompts, processing partners, training data, or trade secrets of the Platform;
- use the Platform to develop, train, fine-tune, or improve any competing product, model, or service;
- resell, repackage, sublicense, or relabel the Platform's editing capabilities as your own competing AI service;
- upload malware, viruses, worms, Trojans, ransomware, time bombs, logic bombs, or any other code intended to disrupt, damage, or gain unauthorized access;
- attempt to gain unauthorized access to accounts, infrastructure, or data not belonging to you;
- conduct denial-of-service, distributed denial-of-service, or any other attack against the Platform or related infrastructure;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- use any automated means to register accounts, claim credits, or trigger promotions;
- create multiple accounts to evade limits, bans, or fees;
- use the Platform to send unsolicited communications (spam) of any kind;
- use the Platform in connection with any activity that violates U.S. or other applicable export-control, sanctions, anti-bribery, or anti-corruption law; or
- encourage or enable any of the above by any third party.
3. Real-estate-specific prohibitions
The Platform exists to serve real-estate marketing. The following uses are prohibited regardless of whether the underlying images or edits would be permissible in another context:
- using outputs to misrepresent property condition, layout, finish, size, value, or any other material feature;
- using outputs to conceal defects, code violations, environmental hazards, or other matters required to be disclosed;
- using outputs in a way that signals preference for or against a fair-housing protected class;
- using outputs to mislead a consumer in violation of any state UDAP statute or FTC advertising rule;
- publishing AI-edited imagery without the disclosures required by your MLS, brokerage, state real-estate commission, or other applicable rules.
4. Security-research carve-out
Good-faith security research is welcome and is not a violation of this AUP, provided that you: (i) act only against your own test accounts; (ii) do not access, modify, or exfiltrate data belonging to another user; (iii) do not exploit vulnerabilities beyond what is necessary to demonstrate them; (iv) do not degrade Platform availability; and (v) report findings privately to abuse@betterlistingmedia.com and allow us a reasonable opportunity to remediate before any public disclosure. We will not pursue legal action against researchers who comply with these conditions.
5. Reporting violations
To report a violation of this AUP, contact abuse@betterlistingmedia.com. To report illegal content involving minors, contact NCMEC's CyberTipline at report.cybertip.org in addition to notifying us.
6. Enforcement
We may, at our sole discretion and without prior notice:
- remove or disable access to violating content;
- suspend or terminate accounts associated with the violation, including all sibling accounts;
- forfeit any remaining platform credits;
- report the violation to law enforcement, regulators, or affected third parties;
- preserve and produce relevant records pursuant to a lawful request; and
- pursue any civil remedies available, including indemnification under our Terms of Service.
Enforcement decisions are final.
7. No safe harbor; AUP is not exhaustive
The categories listed above are illustrative and not exhaustive. Conduct that is not specifically enumerated may still violate this AUP, our Terms of Service, or applicable law. The absence of enforcement against a particular user or content does not waive our right to enforce in the future.
8. Updates
We may update this AUP from time to time. Material changes will be communicated at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
